UKE President Appointed as Coordinator for Digital Services. New Tasks and Powers for UKE

The President of Poland has signed a law amending the Act on the Provision of Electronic Services and certain other laws, which establishes the national framework for the implementation of the Digital Services Act (DSA).

Under the new regulations, the UKE President will serve as the Digital Services Coordinator in Poland and will be granted the powers necessary to carry out the tasks arising from the DSA regulation.

This marks an important step in establishing the national frameworkfor implementing the DSA. Since May 2025, the President of UKE has been performing some of the Coordinator’s tasks pursuant to a resolution of the Council of Ministers, primarily by participating in European cooperation and information exchange. Once the Act enters into force, the scope of his responsibilities will be significantly expanded.

The President of UKE will play a central role in the national DSA implementation system, but will not be the sole authority responsible for its enforcement.

The Act also designates other competent authorities

— the President of Office of Competition and Consumenr Protection  nd

the Chair of National Broadcasting Council — and defines the scope of the tasks entrusted to them.

As the Coordinator, the President of UKE will also be responsible for facilitating cooperation among the competent national authorities and will collaborate with the Coordinators of other Member States, the European Commission, and the European Digital Services Board.

What tasks will the President of UKE be assigned?

Once the Act enters into force, the President of UKE will be primarily responsible for:

•    reviewing user complaints regarding violations by intermediary service providers of their obligations under the DSA Regulation;

•    overseeing compliance with the DSA Regulation by intermediary service providers subject to the jurisdiction of the President of UKE;

•    conducting proceedings and inspections in cases involving violations of the DSA Regulation;

•    enforcing the obligations under the DSA Regulation, including the application of legally prescribed measures and the imposition of administrative fines;

•    certification of alternative dispute resolution bodies;

•    granting the status of a trusted reporting entity;

•    carrying out tasks related to verified researchers’ access to data;

•    coordinating cooperation among competent national authorities and cooperating with the European Commission and the Coordinators of other Member States.

A National Council for Digital Services will also be established under the President of UKE, serving in an advisory capacity on matters related to the application of the DSA Regulation and the functioning of the digital services market.

Who will the UKE President oversee?

The UKE President’s direct oversight will primarily cover indirect service providers with their principal place of business in Poland, as well as other providers subject to Polish jurisdiction in accordance with the DSA Regulation.

With respect to such entities, the UKE President will be able to conduct proceedings, request information, carry out inspections, and apply measures to enforce obligations arising from the DSA, including—in cases specified by law—imposing administrative fines.

The President of UKE will therefore not directly supervise all digital platforms and services available in Poland.

The DSA establishes a European supervisory system in which the jurisdiction of individual authorities depends primarily on the Member State in which the provider has its principal place of business.

If, in accordance with the DSA’s rules, an authority in another Member State is competent, that authority will be responsible for the direct supervision of the provider. In such cases, the President of UKE will cooperate with the relevant Coordinator within the framework of the European cooperation system.

Users will be able to file complaints with UKE

One of the most significant changes for users in Poland will be the launch of the complaint mechanism provided for in Article 53 of the DSA.

A user who believes that an intermediary service provider has violated its obligations under the DSA will be able to file a complaint with the President of UKE. This also applies when the provider has its principal place of business in another Member State.

The President of UKE will assess the complaint and—if the matter falls within the jurisdiction of a Coordinator in another Member State—may refer it to the competent authority. If, however, the President of UKE is the competent authority under the DSA, the matter will be handled by UKE.

As a result, Polish users will be able to utilize the DSA complaint mechanism through the national Coordinator, including in cases involving providers established in other European Union countries.

UKE is preparing a dedicated complaint form and instructions for users. Detailed information on how to file complaints and the required information and documents will be published upon the entry into force of the new regulations.

Orders Concerning Illegal Content—The Next Step

The signed law does not activate all mechanisms related to the application of the DSA in Poland.

In particular, it does not establish a national procedure for issuing orders concerning illegal content, as referred to in Article 9 of the DSA, nor does it grant the President of UKE the authority to issue such orders.

This means that once the law enters into force, the President of UKE will be able to review user complaints, supervise service providers under his jurisdiction, conduct proceedings, and enforce obligations arising from the DSA, but will not, on this basis, issue orders to remove or block access to specific illegal content.

The mechanism governing such orders, including the responsibilities of the President of UKE in this regard, is the subject of a separate legislative process and is to be regulated in a subsequent act implementing the DSA into Polish law.

UKE is preparing for its new responsibilities

UKE is carrying out the organizational, procedural, and technical work necessary to begin exercising its new powers.

These include, among other things, developing a system for handling user complaints, a dedicated form and instructions, procedures for conducting proceedings, and solutions regarding certification and the granting of statuses provided for in the DSA.

We will publish detailed information regarding the new procedures and how to use the mechanisms provided for in the DSA once the Act enters into force.

The Act will enter into force 30 days after its publication in the Journal of Laws.
