
Report of the President of the UKE on Open Internet Access

The President of the Office of Electronic Communications (UKE) has conducted an analysis of compliance in the Polish telecommunications market with the provisions of the Regulation (EU) 2015/2120 of the European Parliament and of the Council on open internet access1 in the period from 1 May 2024 to 30 April 2025.
In this ninth report, the President of UKE examined the commercial practices and traffic management measures used by internet access providers and into specialised services as provided. The report also shows what actions the President of UKE took following an inspection regarding the rules for presenting in contractual documents the information required under Article 4(1)(d) (first part thereof) of the Regulation.
As every year, the report also presents data on the quality of internet access services, this time expanded to include statistics for urban and rural areas.
The analysis of the market situation shows that:
- An audit of compliance by the largest mobile operators providing internet access services with Article 3(2) and (3) of the Regulation confirmed that all operators audited offer access to selected services and content under the ‘zero rating’ model. Therefore, in May 2024, the President of UKE issued relevant audit recommendations to the audited undertakings.
- No negative impact of the provision of specialised services on the availability and overall quality of the internet access service was identified.
- No traffic management practices breaching the rules of open internet access, as referred to in Article 3(3) of the Regulation, were identified.
- As in the previous reporting period, the most frequently reported problem by internet users was the quality of internet access services. Compared to the previous period, the total number of reports increased by approximately 7.8%.
- When analysing the quality data collected in 2025, a continuing clear and steady increase, in the quality parameters of the services provided by the ISPs, specifically, an increase in the average data transfer speed (both download and upload speeds) with a simultaneous decrease in the ping parameter (reduction in data transmission latency). The average download speed for all providers, measured using the SpeedTest.pl web application (available at www.speedtest.pl), covering all access technologies in both fixed and mobile networks, was 160.28 Mbps in April 2025 (i.e. the reference month in which measurements were taken). This represents an increase of 18.84% compared to April 2024.
- In April 2025, a significant increase was recorded in the average download speed for all mobile providers compared to April 2024. The speed increased by 20.84%, reaching 86.86 Mbps in April 2025.
