Decisions of President of the UKE related to cable ducts and telecommunication duct system of buildings

On 11 September 2018, President of the Office of Electronic Communications issued decisions specifying conditions for ensuring access to technical infrastructure – cable ducts and telecommunication duct system of building for:
1. Orange Polska S.A. with its main office in Warsaw 
2. Netia S.A. with its main office in Warsaw 
3. UPC Polska sp. z o. o. with its main office in Warsaw 
4. Multimedia Polska S.A. with its main office in Gdynia 
5. „Vectra Investments” sp. z o. o. sp.j. with its main office in Warsaw 
6. INEA S.A. with its main office in Poznan
7. Toya sp. z o. o. with its main office in Lodz 

The key element of the decisions are two documents: Conditions for ensuring access to technical infrastructure – cable ducts and Conditions for ensuring access to technical infrastructure - telecommunication duct system of buildings. They constitute a universal compilation of principles and rules for the use of infrastructure of a telecommunication undertaking in order to implement a fast telecommunications network.

These decisions result from the Strategic lines of actions of the President of UKE for 2017-2020. The activities of the regulator aim at promoting co-investments, supporting the development and sharing of infrastructure as well as ensuring efficient cooperation among operators. The decisions implement the concepts of the Digital Agenda for Europe and Europe 2020 strategy, thus helping take a step up towards a gigabit society. They also execute the concepts of the Broadband Cost Reduction Directive and of the Act on support of the development of telecommunication networks and services.

The issuing of the decisions was preceded by an analysis of cooperation conditions applied by operators and a number of workshops with the market participants. Moreover, as there was an active discussion in the form of numerous consultation opinions, the draft decisions were consulted twice. The President of UKE took into account the requests submitted in the consultation process, i.e. by determining a 6-month transition period in order to allow for the implementation of the decisions by the telecommunications undertakings in their activity. Consequently, the access conditions, as specified in the decisions, provide an appropriate balancing of rights and obligations of companies which use the infrastructure and companies which grant access to the infrastructure.

In the opinion of the President of UKE, the issuing of these decisions will make a positive impact on increasing the efficiency of using the existing infrastructure and on reducing the costs of new civil engineering works for the benefit of not only the telecommunication undertakings themselves but primarily for the subscribers.
